Last Friday, there was an Initial Hearing by zoom of our Superior Court Appeal in King County. This hearing addressed the two pre-trial motions filed by the developer, MA Center. It confirmed our ability to move forward with our full appeal at the Appeal Hearing in November. The two motions were:
· A motion to dismiss our appeal of “interlocutory” [intermediate / not final] decisions by HEx for lack of jurisdiction – this would have dismissed parts of our appeal if they weren’t related to our SEPA issues (traffic and wildlife) or identified specifically in the HEx decision document. The judge dismissed this motion.
· A motion to dismiss our right to alternative causes of action through constitutional writ and declaratory judgement. The judge granted this motion. This restriction is not significant because those courses of action would likely have been dismissed at some point anyway.
This is an important win. We are appealing the lack of notice and its adverse impacts on the community’s ability to participate in the Conditional Use Permit (CUP) process. Our original SEPA appeal only included the issues we could uncover from outdated documents during the 10 day comment period. During the original hearing before the Hearing Examiner, we were constantly restricted to those issues.
The Superior Court appeal is our opportunity to finally take the developers and our County to court. It will likely cost $35,000. Thanks to community donations and the estate sale, we’ve now raised just under half of our goal. We need to raise $15,000 to reach our goal by October 1, 2022.
